Terms of Service

Last updated 3 September 2026

These terms are an agreement between you and HeyStarky (“Clan”, “we”, “us”), and govern your use of Clan, a family calendar and home organiser. By creating a household or using Clan, you agree to these terms. If you don't agree, please don't use the service.

Who can use Clan

You must be at least 18 years old, or the age of majority where you live, to create a household. You're responsible for anyone you invite and for any information you add about children in your household — add family members and connect accounts only where you're entitled to do so.

Your account

You sign in with a one-time code sent to your email, so keeping access to your email secure is how you keep your account secure. You're responsible for activity within your household. Tell us promptly at hello@heystarky.com.au if you think an account has been compromised.

The service

Clan lets your household organise calendars, tasks, routines, meals, lists, rewards and more, and optionally sync connected calendars and use AI helpers. We're continually improving Clan and may add, change or remove features. We'll try not to disrupt core functionality, but we don't promise any particular feature will always be available.

Subscriptions, trial & billing

Clan may be offered on a paid subscription. Where it is:

  • Payments are processed by Stripe, and your subscription is billed by HeyStarky. By subscribing you authorise recurring charges to your payment method.
  • If a free trial is offered, it converts to a paid subscription when it ends unless you cancel before then.
  • Subscriptions renew automatically each billing period until you cancel. You can cancel at any time through the billing/customer portal, and your plan stays active until the end of the paid period.
  • Except where required by law (including the Australian Consumer Law), payments are non-refundable and we don't provide refunds or credits for partial periods.
  • We may change pricing; we'll give you reasonable notice before a change affects you, and price changes never apply retroactively.

Acceptable use

Use Clan for your own household's organisation. Don't misuse it — including no unlawful, infringing or harmful content, no attempts to breach security, disrupt or overload the service, reverse-engineer it, access other households' data, or use it to build a competing product.

Connected services

When you connect Google, Microsoft or Apple/iCloud, your use of those services remains subject to their own terms and privacy policies, and the access you grant is described in our Privacy Policy. You can disconnect at any time. We're not responsible for outages, changes, or data issues in those third-party services.

Your content

You keep ownership of the events, photos and other content you add. You grant us the limited, non-exclusive licence needed to host, process and display that content so Clan can work for your household — including sending it to the service providers described in our Privacy Policy. You're responsible for having the right to upload and share whatever you add.

AI features

Clan's AI features generate suggestions (such as extracted events, summaries and meal ideas) to help you, and can be inaccurate or incomplete. They're not professional advice. You're responsible for reviewing and confirming anything before you rely on it.

Intellectual property

Clan, including its software, design, branding and content we provide, is owned by HeyStarky and protected by law. These terms don't transfer any of our intellectual property to you beyond the right to use the service as intended.

Availability & disclaimers

Clan is provided on an “as is” and “as available” basis. We work to keep it reliable, but we don't guarantee it will be uninterrupted, timely, secure or error-free, and it isn't a substitute for your own record-keeping. To the fullest extent permitted by law, we exclude implied warranties.

Liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded. Subject to that, to the fullest extent permitted by law we are not liable for indirect, incidental or consequential loss, or for loss of data, profits or goodwill, and our total liability arising out of or relating to Clan is limited to the amount you paid us for the service in the twelve months before the claim (or, where the law requires, to resupplying the service).

Termination

You can stop using Clan and request deletion of your data at any time. We may suspend or end your access if you breach these terms or to protect the service or other users. Sections that by their nature should survive termination (such as content licences already granted, disclaimers and liability limits) will continue to apply.

Changes to these terms

We may update these terms from time to time; we'll revise the date above when we do, and for material changes we'll aim to give you notice. Continuing to use Clan after a change means you accept the updated terms.

Governing law & contact

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of its courts. Questions or requests: hello@heystarky.com.au.
